Facts and technicalities regarding the Richard Bohling trial will be presented to the jury today at the Albany County Courthouse.
Bohling, former Albany County attorney, is facing five felony charges related to buying electronics with government funds under false pretenses. Bohling is also facing two misdemeanor charges – one count of official misconduct and wrongful appropriation of public funds.
Earlier this week Defense Lawyer John Robinson motioned for an acquittal of Bohling on Wednesday, but was denied by Judge John R. Perry of Gillette.
The issue of title and ownership of property in question came as the basis for the acquittal.
“He could never leave office with any of this property, because it all belonged to Albany County,” Robinson said.
Judge Perry told the court the ownership of the property has been his biggest question in the case. It looks like it will be up to the jury to make that distinction.
Today’s trial will begin at 8 a.m. The jury will be presented with a printed sheet containing evidence, legal terms and technicalities and will then be left with the task of making a decision.
A decision could take anywhere from one hour to five days.
