Charged with two counts of aggravated assault and battery with the threat to use a drawn deadly weapon, UW Cowboy football freshman defensive back Allen Smith III was booked into Albany County Detention Center last Friday.

In an affidavit filed with the court, according to the Casper Star Tribune, it stated that Smith had asked the two people who had driven him to the Verge apartments to drop off laundry if they wanted to see his gun. When he came back from the apartment, he pointed the unloaded gun at their heads and pulled the trigger eight times, four for each person.

Both persons told police later that “they thought they were going to die,” according to the affidavit.

Jason Tangeman, Smith’s defense attorney, said the gun used was not a real gun but an unloaded airsoft gun, and Smith did not threaten or point it at anyone. Smith disputes the charges, according to the Casper Star Tribune.

The University of Wyoming, other than having said that Smith was indefinitely suspended of any football-related activities. He did not attend the Tulsa game last weekend, according to MSN. UW athletics officials said they had no further comments on the suspension.

Smith’s preliminary hearing is scheduled for Oct. 15.

In Wyoming, aggravated assault and battery results in penalty if the person threatens to use a drawn deadly weapon on another person, unless in reasonable defense. This felony is punishable by imprisonment for up to 10 years, according to Wyoming Statutes 6-2-502.

Though Smith was a young player for UW’s football team, he was rated as a 2-star recruit by Rivals and 247 Sports during his high school years at Culver City High School in Culver City, California. He played as a cornerback, wide receiver and returned kicks for the school, according to his biography on GoWyo.
